Manion<\/p>\n\n\n\n<p>\n        You may have seen this past week headlines from a variety of \nnews outlets loudly proclaiming the death of conscience rights: \u201c<a href=\"https:\/\/www.washingtonpost.com\/health\/trumps-conscience-rule-for-health-providers-voided-by-federal-judge\/2019\/11\/06\/39aa9b74-00b1-11ea-9518-1e76abc088b6_story.html\" rel=\"noreferrer noopener\" target=\"_blank\">Trump\u2019s \u2018conscience rule\u2019 for health providers blocked by federal judge<\/a>.\u201d \u201c<a href=\"https:\/\/thehill.com\/policy\/healthcare\/469498-second-federal-judge-rules-against-trump-conscience-protection-rule\" rel=\"noreferrer noopener\" target=\"_blank\">Second federal judge strikes down Trump\u2019s \u2018conscience protection\u2019 rule for health care providers<\/a>.\u201d\n Both the headlines and, for the most part, the stories themselves give \nthe impression that, as usual, the independent federal judiciary has had\n to come to the rescue of all that is good and true by thwarting the \nlatest attempt by \u201cTrump\u201d and his \u201creligious right\u201d henchpeople to \nimpose their troglodyte, Taliban-esque views on \n        Americans who just want to be treated in hospitals and doctors\u2019 \noffices without interference from small-minded religious fanatics.<\/p>\n\n\n\n<p>         But it\u2019s fake news. The decisions of the U.S. District Courts in  New York and Washington addressed a set of administrative regulations \u2013  housekeeping stuff \u2013 adopted by the U.S. Department of Health and Human  Services earlier this year for how HHS wants to go about interpreting  and enforcing <em>pre-existing conscience protection laws<\/em>. The laws  themselves remain untouched and, as the New York court made clear, its  decision leaves HHS at liberty to enforce existing conscience laws and  to adopt rules governing how they go about doing that. . .
