{"id":9470,"date":"2014-04-08T09:59:05","date_gmt":"2014-04-08T16:59:05","guid":{"rendered":"https:\/\/news.consciencelaws.org\/?p=9470"},"modified":"2019-09-17T11:14:57","modified_gmt":"2019-09-17T18:14:57","slug":"supreme-court-of-the-philippines","status":"publish","type":"post","link":"https:\/\/news.consciencelaws.org\/?p=9470","title":{"rendered":"Supreme Court of the Philippines"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">The Responsible Parenthood and Reproductive Health Act of 2012 <\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"> Opinions supporting freedom of conscience <\/h3>\n\n\n\n<h3 class=\"wp-block-heading\">Introduction:<\/h3>\n\n\n\n<div style=\"float:left; margin-right:1em;\"><img decoding=\"async\" class=\"wp-image-9472\" style=\"width: 150px;\" src=\"https:\/\/news.consciencelaws.org\/wp-content\/uploads\/2019\/09\/philippines-supreme-crt.png\" alt=\"Supreme Court of the Philippines\"><\/div><p>In&nbsp; April, 2014, the Protection of Conscience Project&#8217;s <a href=\"https:\/\/news.consciencelaws.orglaw\/commentary\/legal055-001.aspx\">critique<\/a> of the <em>Responsible Parenthood and Reproductive Health Act of 201<\/em>2  (<em>RH Act<\/em>) was confirmed by a ruling of the Supreme Court of the Philippines.&nbsp;<\/p>\n\n\n\n<p>With respect to the issue of freedom of conscience among health \ncare workers and institutions, of the fifteen Supreme Court judges: <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>11 held that the mandatory referral provision in the law \n\t\t\twas an unconstitutional violation of freedom of conscience;<\/li><li>&nbsp;10 of the 11 also ruled that forcing an objecting health \n\t\t\tcare worker to provide &#8220;complete and correct information&#8221; about \n\t\t\tcontraception was a violation of freedom of conscience<ul><li>The eleventh judge (Del&nbsp; Castillo, J.) held that a requirement \nto provide complete and correct information was not unconstitutional, <em>as long as it was <strong>not<\/strong> used <\/em>to suppress the freedom of \n\t\t\t\tobjecting health care workers to express professional or other \n\t\t\t\topinions concerning contraception.<\/li><\/ul>\n\t\t\t<\/li><\/ul>\n\n\n\n<div style=\"float:none; margin-bottom:1em;\"><div style=\"float:left; width:50%;\"><strong>MAJORITY<\/strong><br>\n    Lucas P. On Religious Accommodation and The Duty to Refer&nbsp; [P.61]<\/strong><br> Petitioners Imbong and Luat note that while the <em>RH Law<\/em> attempts to  address religious sentiments by making provisions for a conscientious  objector, the constitutional guarantee is nonetheless violated because the  law also imposes upon the conscientious objector the duty to refer the  patient seeking reproductive health services to another medical  practitioner who would be able to provide for the patient&#8217;s needs. For  the petitioners, this amounts to requiring the conscientious objector to  cooperate with the very thing he refuses to do without violating his\/her  religious beliefs.190  . . .
