{"id":9290,"date":"2019-08-07T19:23:13","date_gmt":"2019-08-08T02:23:13","guid":{"rendered":"https:\/\/news.consciencelaws.org\/?p=9290"},"modified":"2019-09-01T17:49:52","modified_gmt":"2019-09-02T00:49:52","slug":"euthanasia-bill-falls-short-on-freedom-of-conscience","status":"publish","type":"post","link":"https:\/\/news.consciencelaws.org\/?p=9290","title":{"rendered":"Euthanasia bill falls short on freedom of conscience"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Objecting students unprotected, refusal may incur civil, criminal liability<\/h2>\n\n\n\n<p class=\"author\">Sean Murphy<a href=\"https:\/\/www.consciencelaws.org\/authors.aspx#Sean_Murphy\">*<\/a><\/p>\n\n\n\n<p>Western Australia&#8217;s <a href=\"https:\/\/ww2.health.wa.gov.au\/~\/media\/Files\/Corporate\/general%20documents\/Voluntary%20assisted%20dying\/PDF\/Voluntary-Assisted-Dying-Bill-2019.pdf\">Voluntary Assisted Dying Bill 2019<\/a> includes provisions intended to protect all registered health practitioners who refuse to participate for reasons of conscience.  By virtue of the <em>Health Practitioner Regulation National Law <\/em>(Western Australia) this includes nurses, midwives, pharmacists, radiologists, psychologists and other professions. <\/p>\n\n\n\n<p>However, the bill <a href=\"https:\/\/news.consciencelaws.orglaw\/proposed\/australia-west-002.aspx#registered\">explicitly excludes students<\/a>, probably to ensure that only non-student practitioners are permitted to  accept and process requests, assess patients and provide euthanasia or  assisted suicide (EAS).&nbsp; Unfortunately, the effect of this exclusion is that  nothing in the bill prevents students from being required to participate  in all aspects of EAS delivery under the direction of a fully qualified  registered health practitioner, or making such practical training a  requirement for professional qualification.&nbsp; This would be inconsistent  with one of the guiding principles in the bill (<a href=\"https:\/\/news.consciencelaws.orglaw\/proposed\/australia-west-002.aspx#4(1)\">Section 4(1)j<\/a>), so it may be an oversight that will be corrected during the legislative process.<\/p>\n\n\n\n<p>Fully qualified registered health practitioners may refuse to\n participate in the request and assessment process, prescription, supply\n or administration of lethal drugs, and to be present when the drugs are\n administered (<a href=\"https:\/\/news.consciencelaws.orglaw\/proposed\/australia-west-002.aspx#9(1)\">Section 9(1)<\/a>).&nbsp;\n The bill further states that, by identifying these actions, it does not\n intend &#8220;to limit the circumstances in which a registered health \npractitioner may refuse&#8221; to do them (<a href=\"https:\/\/news.consciencelaws.orglaw\/proposed\/australia-west-002.aspx#9(2)\">Section 9(2)<\/a>).&nbsp;\n This would seem to extend protection to include refusal to do do things\n not specified in the section, but obviously related to providing \neuthanasia or assisted suicide, like setting an intravenous line for \nadministration of lethal drugs.&nbsp; That interpretation is consistent with <a href=\"https:\/\/news.consciencelaws.orglaw\/proposed\/australia-west-002.aspx#vad\">the definition of <em>voluntary assisted dying<\/em><\/a><em>, <\/em>whichincludes\n &#8220;steps reasonably related to such administration.&#8221;&nbsp; Clearly, this would\n include any of the actions explicitly required by the law, such as \nassessments, notifications, acting as a witness, dispensing lethal \ndrugs, \n            filing reports, etc., as well as setting intravenous lines \nand other technical preparations for providing EAS.<\/p>\n\n\n\n<p>\n            Sections <a href=\"https:\/\/news.consciencelaws.orglaw\/proposed\/australia-west-002.aspx#112.\">112<\/a> and <a href=\"https:\/\/news.consciencelaws.orglaw\/proposed\/australia-west-002.aspx#113.\">113<\/a> provide protection from \n\t\t\t\t\t\t\t\t\tcivil and criminal liability and \n\t\t\t\t\t\t\t\t\tdisciplinary proceedings for those involved \n\t\t\t\t\t\t\t\t\tin processing and fulfilling EAS requests if they act in accordance with the law. <a href=\"https:\/\/news.consciencelaws.orglaw\/proposed\/australia-west-002.aspx#113(4)\">Section 113(4)<\/a> extends this protection to <em>omissions<\/em> in accordance with the bill, but not to the <em>refusals<\/em>\n it permits.&nbsp; Since &#8220;omission&#8221; does not mean &#8220;refusal&#8221;, this may reflect\n either an oversight in drafting or a deliberate decision to expose \nobjecting practitioners to liability.<\/p>\n\n\n\n<p>\n            What could prove to be most contentious is the requirement in <a href=\"https:\/\/news.consciencelaws.orglaw\/proposed\/australia-west-002.aspx#19(5)b\">Section 19(5)b<\/a>\n that an objecting physician give a patient &#8220;information approved by the\n CEO&#8221; of a public service department, perhaps a health department.&nbsp; \nWhether this will be acceptable to objecting practitioners will depend \nentirely on the substance of the &#8220;approved&#8221; information.&nbsp; It is unlikely\n to be problematic if it consists of general information about how to \ncontact other physicians or health authorities.&nbsp; On the other hand, \nresistance is likely if the &#8220;approved&#8221; information portrays euthanasia \nand assisted suicide as morally acceptable services or directs patients \nto EAS providers.&nbsp; Objecting practitioners may refuse to comply if the \nlaw effectively compels them to express support for moral views they \nreject, or forces them to facilitate what they consider to be immoral or\n unethical acts by directing patients to EAS providers.<\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Objecting students unprotected, refusal may incur civil, criminal liability Sean Murphy* Western Australia&#8217;s Voluntary Assisted Dying Bill 2019 includes provisions intended to protect all registered health practitioners who refuse to participate for reasons of conscience.
