{"id":9261,"date":"2019-05-17T09:52:09","date_gmt":"2019-05-17T16:52:09","guid":{"rendered":"https:\/\/news.consciencelaws.org\/?p=9261"},"modified":"2019-09-01T18:08:25","modified_gmt":"2019-09-02T01:08:25","slug":"ontario-court-of-appeal-supports-effective-referral-for-morally-contested-procedures-including-euthanasia","status":"publish","type":"post","link":"https:\/\/news.consciencelaws.org\/?p=9261","title":{"rendered":"Ontario Court of Appeal supports \u2018effective referral\u2019 for morally contested procedures, including euthanasia"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\"><br> Court unanimously affirms right of state to compel participation in homicide, suicide, etc.<\/h2>\n\n\n\n<p><strong>News Release<\/strong><\/p>\n\n\n\n<p class=\"author\">Protection of Conscience Project<\/p>\n\n\n\n<p>On 15 May, 2019, three judges of the Ontario Court of Appeal unanimously upheld a lower court ruling that physicians can be forced to facilitate procedures they find morally objectionable,  including euthanasia and assisted suicide, by connecting patients with willing providers (\u201ceffective referral\u201d).<\/p>\n\n\n\n<p><a href=\"http:\/\/www.ontariocourts.ca\/decisions\/2019\/2019ONCA0393.htm\">The Court of Appeal judgement<\/a> concerned a <a href=\"http:\/\/www.ontariocourts.ca\/search-canlii\/scj\/dv-en.htm\">2018 decision<\/a> by the Ontario Divisional Court that had been appealed by the Christian Medical and Dental Society of Canada and others.  The litigation was a response to a compulsory \u201ceffective referral\u201d policy imposed by Ontario\u2019s state medical regulator, the College of Physicians and Surgeons of Ontario.<\/p>\n\n\n\n<p>The Protection of Conscience Project, Catholic Civil Rights League and Faith and Freedom Alliance jointly intervened at trial and in the appeal in support of freedom of conscience.<\/p>\n\n\n\n<p>The Divisional Court and the Court of Appeal both acknowledged the joint intervention, but neither considered <a href=\"https:\/\/news.consciencelaws.orgarchive\/documents\/cpso\/2018-11-12-factumappeal.PDF\">the arguments<\/a> it proposed because the case was decided solely on the basis of freedom of religion claims.  The Court of Appeal held that the evidence at trial was \u201cinsufficient to support an analysis of freedom of conscience.\u201d<\/p>\n\n\n\n<p>\u201cTo the extent the individual appellants raise issues of conscience,\u201d said the Court, \u201cthey are inextricably grounded in their religious beliefs,\u201d so that, \u201cat its core, the appellants\u2019 claim is grounded in freedom of religion.\u201d[para. 85]<\/p>\n\n\n\n<p>Since the arguments in the Project\u2019s intervention were not addressed at trial or in the appeal, Project Administrator Sean Murphy believes that they are unaffected by the decision.<\/p>\n\n\n\n<p>\u201cThe focus of the Court was on religiously-motivated refusal to participate in perceived wrongdoing,\u201d said Murphy. \u201cThe analytical framework proposed in the joint intervention could easily have been adapted and applied to that particular form of the exercise of religious freedom.  The evidentiary record would have been sufficient for that purpose.\u201d<\/p>\n\n\n\n<p>\u201cHowever, the Court did not do this, so the arguments still stand, and they can be raised again in another appropriate case.\u201d  <\/p>\n\n\n\n<p>The decision demonstrates that the judges uncritically adopted the view of the College that euthanasia, assisted suicide, abortion, contraception, sterilization, sex change surgery, etc. are acceptable forms of medical treatment or health care.  They further noted that abortion, euthanasia and assisted suicide \u201ccarry the stigmatizing legacy of several centuries of criminalization grounded in religious and secular morality.\u201d [para. 123].
