{"id":8036,"date":"2018-01-31T20:05:17","date_gmt":"2018-02-01T04:05:17","guid":{"rendered":"https:\/\/news.consciencelaws.org\/?p=8036"},"modified":"2018-03-04T19:13:43","modified_gmt":"2018-03-05T03:13:43","slug":"ontario-court-rules-doctors-who-oppose-assisted-death-must-refer-patients","status":"publish","type":"post","link":"https:\/\/news.consciencelaws.org\/?p=8036","title":{"rendered":"Ontario court rules doctors who oppose assisted death must refer patients"},"content":{"rendered":"<p><em><strong>The Globe and Mail<\/strong><\/em><\/p>\n<p class=\"author\">Sean Fine<\/p>\n<p>In the first Canadian test of conscience rights for doctors who oppose assisted death, an Ontario court has upheld regulations requiring the objectors to refer their patients to physicians willing to perform the procedure.<\/p>\n<p>Groups representing 4,700 Christian doctors had challenged Ontario\u2019s regulations requiring the referrals, saying that making such a referral was morally equivalent to participating in an assisted death.<\/p>\n<p>But Ontario\u2019s Divisional Court said the referral rule was a reasonable limit on doctors\u2019 freedom of religion because it protects vulnerable patients from harm. And those patients, it said, have a constitutional right to equitable access to publicly funded health care.<\/p>\n<p>Without the policy of \u201ceffective referral,\u201d equitable access would be \u201ccompromised or sacrificed, in a variety of circumstances, more often than not involving vulnerable members of our society at the time of requesting services,\u201d Justice Herman Wilton-Siegel wrote in the 3-0 ruling on Wednesday. . .
