{"id":674,"date":"2012-02-09T16:12:10","date_gmt":"2012-02-10T00:12:10","guid":{"rendered":"https:\/\/news.consciencelaws.org\/?p=674"},"modified":"2018-03-05T21:50:55","modified_gmt":"2018-03-06T05:50:55","slug":"michigan-takes-lead-role-in-lawsuits-against-unconstitutional-obama-health-care-mandate","status":"publish","type":"post","link":"https:\/\/news.consciencelaws.org\/?p=674","title":{"rendered":"Michigan Takes Lead Role in Lawsuits Against Unconstitutional Obama Health Care Mandate"},"content":{"rendered":"<h2><em>Schuette Heads Up Multi-State Effort With Becket Fund To <\/em><em>Defend Religious Liberty, First Amendment<\/em><\/h2>\n<p><strong>NEWS RELEASE<\/strong><\/p>\n<p class=\"author\"><a href=\"http:\/\/www.michigan.gov\/ag\/\">Attorney General of Michigan<\/a><\/p>\n<p><strong>Contact:<\/strong> John Sellek or Joy Yearout, 517-373-8060<\/p>\n<p><em> <\/em><strong>LANSING <\/strong>\u2013 Michigan Attorney General Bill Schuette today announced Michigan will be the lead state in an effort to defend religious liberty in three separate lawsuits filed by <a href=\"http:\/\/www.becketfund.org\/\">The Becket Fund for Religious Liberty<\/a> on behalf of two colleges and a religious broadcasting network challenging onerous administrative health care <a href=\"https:\/\/www.consciencelaws.org\/law\/commentary\/legal065-004.aspx\">regulations <\/a>recently handed down by the Obama administration.<\/p>\n<p>\u201cWe cannot compromise religious liberty.\u00a0 We cannot undermine constitutional protections.\u00a0 We cannot trample freedom of religion in the United States of America,\u201d said Schuette.\u00a0 \u201cThis mandate is an unconscionable intrusion on religious liberty and undermines the constitutional rights of millions of Americans with deeply held beliefs.<\/p>\n<p>\u201cNot only will many schools, hospitals and charities be ordered to provide services that violate their conscience, but to add insult to injury, they will have to pay for those they find morally repugnant.\u00a0 This is a radical attack on the First Amendment that cannot stand.\u201d<\/p>\n<p>As described in The Becket Fund\u2019s complaints filed in federal courts in the District of Columbia, Colorado and Alabama, the challenges relate to Obamacare regulations that force thousands of religious organizations to violate their deepest beliefs by mandating what the organizations must include in their employee health plans, or face steep government fines.\u00a0 Although the Obama administration has provided thousands of exemptions for other groups, including many large corporations, it has persistently refused to give the same accommodation to religious organizations exercising their First Amendment freedoms.\u00a0 Schuette\u2019s office will coordinate the drafting and filing of an amicus brief in defense of religious liberty.<\/p>\n<p>On January 20, 2012, the Obama Administration <a href=\"http:\/\/www.hhs.gov\/news\/press\/2012pres\/01\/20120120a.html\">announced <\/a>that it would not change its mandate forcing religious employers to purchase and provide health care services that violate their religious beliefs and moral convictions.\u00a0 The decision was announced in spite of concerns expressed by a wide spectrum of religious leaders and employers.<\/p>\n<p>The cases challenging the rule are <em><a href=\"http:\/\/www.becketfund.org\/wp-content\/uploads\/2011\/11\/HHS-Complaint-Final11.10.11.pdf\"> Bemont Abbey College v.\u00a0 Sebelius<\/a><\/em>, <em><a href=\"http:\/\/law.justia.com\/cases\/federal\/district-courts\/colorado\/codce\/1:2011cv03350\/130236\/5\/\"> Colorado Christian University v. Sebelius<\/a>,<\/em> and <em><a href=\"http:\/\/www.becketfund.org\/wp-content\/uploads\/2012\/02\/EWTN-Complaint-file-stamped.pdf\"> Eternal Word Television Netwprl v. Sebelius<\/a>. <\/em>A briefing schedule has not yet been issued in those cases yet, but Michigan expects to file its briefs later this year.<\/p>\n<p>Schuette\u2019s involvement in The Becket Fund cases is the latest effort to defend religious liberty for Michigan citizens:<\/p>\n<p>\u00b7In 2011, Schuette file joined The Becket Fund to file an <a href=\"http:\/\/www.americanbar.org\/content\/dam\/aba\/publishing\/previewbriefs\/Other_Brief_Updates\/10-553_petitioneramcumiand7states.authcheckdam.pdf\"> amicus brief<\/a> on behalf of seven other states in support of religious liberty in a significant case involving the right of religious organizations to manage their religious employees without government interference.\u00a0 In January 2010, the U.S. Supreme Court unanimously (9-0) upheld the right of religious organizations to manage their religious employees without government interference in <em>Hosanna-Tabor Evangelical Lutheran Church and School v.
