href=\"https:\/\/news.consciencelaws.orgauthors.aspx#Sean_Murphy\"><span style=\"text-decoration: underline;\"><span style=\"color: #0066cc;\">*<\/span><\/span><\/a><\/p>\n<p>Quebec&#8217;s <em><a href=\"https:\/\/news.consciencelaws.orgbackground\/procedures\/assist009-041.aspx\"><span style=\"text-decoration: underline;\"><span style=\"color: #0066cc;\"> Act Respecting End of Life Care<\/span><\/span><\/a><\/em> (ARELC) was passed in June, 2014 and comes into effect in December, 2015.\u00a0 When enacted, the\u00a0 law purported to legalize euthanasia in the province, but its actual legal effect was questionable because Canadian provinces do not have jurisdiction over criminal law.\u00a0 Only the Canadian federal government can make laws governing homicide and suicide.<\/p>\n<p>However, in February, 2015, the Supreme Court of Canada released its decision in the case of <em><a href=\"https:\/\/scc-csc.lexum.com\/scc-csc\/scc-csc\/en\/item\/14637\/index.do\"><span style=\"text-decoration: underline;\"><span style=\"color: #0066cc;\"> Carter vs. Canada<\/span><\/span><\/a>. <\/em>The Court <a href=\"http:\/\/consciencelaws.org\/law\/commentary\/legal073-010.aspx\"><span style=\"text-decoration: underline;\"><span style=\"color: #0066cc;\"> struck down the criminal prohibition<\/span><\/span><\/a> of homicide and assisted suicide to the extent that it prevents the provision of physician assisted suicide and physician administered euthanasia for a certain class of patients.\u00a0 The Court specified that the law cannot prevent the procedures for competent adults who are suffering intolerably as a result of a grievous and irremediable medical condition, which cannot be relieved by other means acceptable to the patient.\u00a0 The declaration of invalidity was suspended for one year to allow the government time to revise the law.<\/p>\n<p>The federal government under Conservative Prime Minister Stephen Harper took no action until mid-July, when it <a href=\"http:\/\/news.gc.ca\/web\/article-en.do?nid=1002949\"><span style=\"text-decoration: underline;\"><span style=\"color: #0066cc;\">appointed a panel <\/span><\/span><\/a>to study the issue and offer advice about legislative options.\u00a0 The government was defeated in the federal election in October, and it remains unclear what direction the new Liberal government will take.<\/p>\n<p>ARELC thus comes into force about two months before the Supreme Court ruling in <em>Carter<\/em> takes effect, while the criminal prohibition of euthanasia and assisted suicide is still in place.\u00a0 However, the guidelines for euthanasia in ARELC are actually more restrictive than those proposed by the Supreme Court of Canada in <em>Carter<\/em>, so it seems doubtful that the federal government will challenge the Quebec law.<\/p>\n<p>In August, 2015, the state regulators of the professions of medicine, pharmacy and nursing jointly issued an 88 page <em>Medical Aid in Dying Practice Guide<\/em> to direct the provision of euthanasia in Quebec.\u00a0 The Guide appears to be available only in French, and is currently accessible only through a <a href=\"http:\/\/www.cmq.org\/publications-pdf\/p-1-2015-09-10-fr-aide-medicale-a-mourir.pdf\"><span style=\"text-decoration: underline;\"><span style=\"color: #0066cc;\"> password protected portal <\/span><\/span><\/a>on the Coll\u00e8ge des m\u00e9decins du Qu\u00e9bec website, or by making an access to information request.\u00a0 However, the Guide also states that it can be reproduced as long as the source is acknowledged.<\/p>\n<p>What follows is a partial machine assisted English translation of the <em>Guide<\/em> set opposite the original French text.\u00a0 For ease of reference, each translated segment is identified by a translation number (T#).\u00a0 Only those parts of the <em>Guide<\/em>
