size-medium alignleft\" src=\"http:\/\/consciencelaws.org\/blog\/wp-content\/uploads\/2015\/08\/cpss-policy-2015-06-19-1-232x300.png\" alt=\"Project to Saskatchewan regulator: no evidence to support limitation of fundamental freedoms\" width=\"232\" height=\"300\" \/>For the third time this year, the Protection of Conscience Project has criticized a draft policy proposed by officials of the College of Physicians and Surgeons of Saskatchewan\u00a0who want to control the exercise of freedom of conscience and religion by physicians.\u00a0 The draft policy, <a href=\"https:\/\/www.consciencelaws.org\/archive\/documents\/cpss\/2015-06-19-con-obj.pdf\" target=\"_blank\" rel=\"noopener\"><em>Conscientious Objection<\/em><\/a>, was approved in principle by the College Council on 19 June and released for a public consultation that ended on 7 August.<\/p>\n<p>Citing Section 1 of the <em>Canadian Charter of Rights and Freedoms<\/em>,\u00a0the Project <a href=\"https:\/\/consciencelaws.org\/publications\/submissions\/submissions-016-001-cpss.aspx#III.\" target=\"_blank\" rel=\"noopener\">states<\/a> that &#8220;the limits proposed in <em>Conscientious Objection<\/em> are neither reasonable nor demonstrably justified&#8221; because the College had no evidence that conscientious objection by Saskatchewan physicians has ever deprived anyone\u00a0of access medical services or adversely affected anyone&#8217;s health.<\/p>\n<p>The\u00a0<a href=\"https:\/\/consciencelaws.org\/publications\/submissions\/submissions-016-001-cpss.aspx\" target=\"_blank\" rel=\"noopener\">Project submission<\/a>\u00a0calls <em>Conscientious Objection<\/em> unacceptable\u00a0\u00a0&#8220;because it attacks the character and competence of objecting physicians, and it nullifies their freedom of conscience by compelling them to arrange for patients to obtain services to which they object.&#8221;<\/p>\n<p>This has become of particular concern because physician assisted suicide and physician administered euthanasia will be legal in Canada in February of next year.\u00a0 The draft policy states that it does not apply to those services, but the Project submission rejects that disclaimer, calling it &#8220;ill-advised and misleading.&#8221;<\/p>\n<p>Among other things, the\u00a0Project <a href=\"https:\/\/consciencelaws.org\/publications\/submissions\/submissions-016-App-B-cpss.aspx#B6.\" target=\"_blank\" rel=\"noopener\">points out <\/a>that, even <em>after<\/em> the\u00a0Supreme Court of Canada ordered the legalization of\u00a0physician assisted suicide and euthanasia, the College&#8217;s\u00a0Associate Registrar\u00a0&#8220;defended the proposition that physicians should be disciplined or fired if they refuse to at least help to find someone willing to kill patients or help them commit suicide.&#8221;<\/p>\n<p>The disclaimer was added only after it became clear that the policy faced overwhelming opposition,\u00a0either\u00a0as a tactic to secure the approval of the policy, or because some of its supporters began to realize the policy&#8217;s implications.<\/p>\n<p>The\u00a0submission warns the College that a policy on conscientious objection should be flexible enough to apply to requests for assisted suicide and euthanasia.<\/p>\n<p>&#8221;\u00a0If Council is uncertain how this can be done, it should postpone policy development concerning <em>Conscientious Objection<\/em> until after the <em>Carter<\/em> decision comes into force in 2016.&#8221;<\/p>\n<p>The Project also strongly criticizes the policy because it\u00a0suggests that physicians who refuse to do what they believe to be wrong cannot be trusted.<\/p>\n<p>&#8220;Solely on the basis of their beliefs,&#8221; <a href=\"https:\/\/consciencelaws.org\/publications\/submissions\/submissions-016-001-cpss.aspx#VI.10\" target=\"_blank\" rel=\"noopener\">the submission notes<\/a>,\u00a0&#8220;it implies that they are unacceptably biased and effectively prohibits objecting physicians from communicating with their patients about morally contested procedures.&#8221;<\/p>\n<p>Instead, the policy demands\u00a0that they refer their patients to someone who can provide &#8220;full and balanced health information,&#8221; apparently assuming that physicians who have moral viewpoints\u00a0are incapable of properly communicating with patients.<\/p>\n<p>&#8220;But all physicians have moral viewpoints,&#8221; the Project reminds the College. &#8220;<em>Conscientious Objection<\/em> simply exchanges one kind of &#8216;bias&#8217; for another.&#8221;<\/p>\n<p>The Project submission includes an <a href=\"https:\/\/consciencelaws.org\/publications\/submissions\/submissions-016-App-C-cpss.aspx#C1.\" target=\"_blank\" rel=\"noopener\">alternative\u00a0policy <\/a>that protects physician freedom of conscience and religion but does not obstruct patient access to services, including euthanasia and assisted suicide.\u00a0 The alternative draws on the CPSS draft policy, the Canadian Medical Association <a href=\"http:\/\/policybase.cma.ca\/dbtw-wpd\/PolicyPDF\/PD04-06.pdf\" target=\"_blank\" rel=\"noopener\"><em>Code of Ethics<\/em><\/a>, and a <a href=\"https:\/\/www.consciencelaws.org\/background\/\/policy\/associations-001.aspx\" target=\"_blank\" rel=\"noopener\">joint statement<\/a> by the Canadian Medical Association, Canadian Healthcare Association, Canadian Nurses&#8217; Association, and Catholic Health Association of Canada.<\/p>\n<p>The proposed CPSS policy\u00a0has also been\u00a0criticized by the Christian Medical and Dental Societies, the Federation of Catholic Physicians\u00a0Societies of Canada and Canadian Physicians for Life.\u00a0 \u00a0Their<a href=\"http:\/\/www.cmdscanada.org\/my_folders\/CPSO_CPSS\/Submissions_of_the_CMDS_CFCPS_and_CPL_-_Final.pdf\" target=\"_blank\" rel=\"noopener\"> joint submission <\/a>states that <em>Conscientious Objection<\/em> &#8220;does not adequately deal with physicians&#8217; human rights&#8221; and &#8220;does not accurately reflect the
