{"id":6141,"date":"2015-05-24T20:59:30","date_gmt":"2015-05-25T03:59:30","guid":{"rendered":"https:\/\/news.consciencelaws.org\/?p=6141"},"modified":"2018-03-07T10:56:45","modified_gmt":"2018-03-07T18:56:45","slug":"illinois-controversy-about-legislative-overreach","status":"publish","type":"post","link":"https:\/\/news.consciencelaws.org\/?p=6141","title":{"rendered":"Illinois controversy about legislative overreach"},"content":{"rendered":"<h2>\u00a0Catholic bishops withdraw opposition, others remain opposed<\/h2>\n<p><strong>Confrontation centres on complicity<\/strong><\/p>\n<p class=\"author\">Sean Murphy<a href=\"https:\/\/www.consciencelaws.org\/authors.aspx#Sean_Murphy\">*<\/a><\/p>\n<p><strong>\u00a0Introduction<\/strong><\/p>\n<p>Among American states, Illinois has the most comprehensive protection of conscience legislation, the <em> <a href=\"https:\/\/www.consciencelaws.org\/law\/laws\/usa-illinois.aspx#Health%20Care%20Right%20of%20Conscience%20Act\"> Health Care Right of Conscience Act<\/a><\/em>\u00a0(HCRCA). In 2009 an attempt was made to nullify the <em>Act<\/em> with respect to abortion, contraception and related procedures by introducing <a href=\"https:\/\/www.consciencelaws.org\/repression\/repression054.aspx\">HB 2354 (<em>Reproductive Health and Access Act<\/em>)<\/a>, but the bill died in committee two years later.<a class=\"endnote\" href=\"https:\/\/www.consciencelaws.org\/law\/commentary\/legal009.aspx#001.\"><span style=\"font-size: small;\">1<\/span><\/a>\u00a0Now it appears that the HRCA may be changed by Senate Bill 1564. Critics say the bill tramples upon physician freedom of conscience,<a class=\"endnote\" href=\"https:\/\/www.consciencelaws.org\/law\/commentary\/legal009.aspx#002.\"><span style=\"font-size: small;\">2<\/span><\/a> while the bill&#8217;s supporters, like the American Civil Liberties Union (ACLU), claim that the bill is &#8220;about making sure no one is withholding information from the patient.&#8221;<a class=\"endnote\" href=\"https:\/\/www.consciencelaws.org\/law\/commentary\/legal009.aspx#003.\"><span style=\"font-size: small;\">3<\/span><\/a><\/p>\n<p>SB 1564 was actually drafted by the ACLU,<a class=\"endnote\" href=\"https:\/\/www.consciencelaws.org\/law\/commentary\/legal009.aspx#003.\"><span style=\"font-size: small;\">3<\/span><\/a> but it was introduced by Illinois Senator Daniel Biss. He said that the amendments were partly in response to the case of a woman who was miscarrying over several weeks, but who was refused &#8220;diagnosis or options&#8221; in the hospital where she had sought treatment.<a class=\"endnote\" href=\"https:\/\/www.consciencelaws.org\/law\/commentary\/legal009.aspx#004.\"><span style=\"font-size: small;\">4<\/span><\/a>\u00a0 Senator Bliss was apparently referring to the story of Mindy Swank, who testified before a Senate legislative panel about her experience.\u00a0 The <em>Illinois Times<\/em> reported that she suffered &#8220;a dangerous, weeks-long miscarriage&#8221; because of the refusal of Catholic hospitals to provide abortions.<a class=\"endnote\" href=\"https:\/\/www.consciencelaws.org\/law\/commentary\/legal009.aspx#005.\"><span style=\"font-size: small;\">5 <\/span><\/a><\/p>\n<p>Unfortunately, the Illinois Senate Judiciary Committee does not record or transcribe its hearings, and conflicting news reports make it difficult to determine exactly what happened at some critical points in her story.\u00a0 Moreover, it appears that the Committee did not hear from the hospitals and physicians who were involved with Ms. Swank, so we are left with a one-sided account of what took place.<a class=\"endnote\" href=\"https:\/\/www.consciencelaws.org\/law\/commentary\/legal009.aspx#006.\"><span style=\"font-size: small;\">6<\/span><\/a><\/p>\n<p>Nonetheless, as a first step in considering the particulars of the bill and the controversy it has engendered, it is appropriate to review the evidence offered to support it.\u00a0 We will begin with Mindy Swank&#8217;s testimony, even if some details are lacking, and then examine the experience of Angela Valavanis, a second case put forward by the ACLU to justify SB 1564.<a class=\"endnote\" href=\"https:\/\/www.consciencelaws.org\/law\/commentary\/legal009.aspx#007.\"><span style=\"font-size: small;\">7<\/span><\/a>\u00a0 [<a href=\"https:\/\/www.consciencelaws.org\/law\/commentary\/legal009.aspx\" target=\"_blank\"><strong>Full Text<\/strong><\/a>]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u00a0Catholic bishops withdraw opposition, others remain opposed Confrontation centres on complicity Sean Murphy* \u00a0Introduction Among American states, Illinois has the most comprehensive protection of conscience legislation, the Health Care Right of Conscience Act\u00a0(HCRCA).
