{"id":4808,"date":"2014-02-03T01:51:51","date_gmt":"2014-02-03T09:51:51","guid":{"rendered":"https:\/\/news.consciencelaws.org\/?p=4808"},"modified":"2018-03-05T13:05:02","modified_gmt":"2018-03-05T21:05:02","slug":"judge-rules-family-cannot-order-caregivers-to-starve-mother-to-death","status":"publish","type":"post","link":"https:\/\/news.consciencelaws.org\/?p=4808","title":{"rendered":"Judge rules family cannot order caregivers to starve mother to death"},"content":{"rendered":"<p>In a 44 page <a href=\"http:\/\/www.courts.gov.bc.ca\/jdb-txt\/SC\/14\/01\/2014BCSC0165.htm\" target=\"_blank\">judgement<\/a>, Mr. Justice Greyell of the Supreme Court of British Columbia has ruled that family members cannot order caregivers at a nursing home to starve an 83 year old resident to death.\u00a0 Margot Bentley, age 83, is in the final stages of Alzheimer&#8217;s disease.\u00a0 Based on written instructions she left before being diagnosed with the disease, family members went to court to stop caregivers from spoonfeeding her when she opened her mouth to accept food.\u00a0 The judge noted that\u00a0she is not dying, and that to comply with their wishes wold mean that Mrs. Bentley would die from starvation and dehydration and not\u00a0an underlying\u00a0disease.<\/p>\n<p>Having considered the evidence, he rejected\u00a0the claim\u00a0that Mrs.\u00a0 Bentley is in a &#8220;vegetative state&#8221; as &#8220;neither useful nor accurate,&#8221; concluding, instead, that it was possible that she had sufficient mental function to decide whether or not to eat and drink and to communicate that decision in non-verbal ways.\u00a0 He held that spoon-feeding was not &#8220;health care&#8221; within the meaning of the law, but a form of personal care.\u00a0 While he agreed that, under the common law, a competent adult can refuse food and fluids and thus commit suicide, he ruled that there was no legal precedent for the finding that such a decision could be made on behalf of an incompetent person by a proxy decision maker.\u00a0 On the other hand he recognized statutory and public policy considerations that would tell against such a finding.<\/p>\n<p>The case is of interest because it demonstrates how the kind of directives the family pursued in this case can generate conflicts of conscience among caregivers and health care workers.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In a 44 page judgement, Mr. Justice Greyell of the Supreme Court of British Columbia has ruled that family members cannot order caregivers at a nursing home to starve an 83 year old resident to death.\u00a0 Margot Bentley, age 83, is in the final stages of Alzheimer&#8217;s disease.\u00a0 Based on written instructions she left before &hellip; <a href=\"https:\/\/news.consciencelaws.org\/?p=4808\" class=\"more-link\">Continue reading<span class=\"screen-reader-text\"> &#8220;Judge rules family cannot order caregivers to starve mother to death&#8221;<\/span><\/a><\/p>\n","protected":false},"author":5432,"featured_media":0,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[77,32,162,217,9],"tags":[76,3266,1127],"post_folder":[],"class_list":["post-4808","post","type-post","status-publish","format-standard","hentry","category-assisted-suicide","category-canada","category-euthanasia","category-lawsuits","category-news","tag-assisted-nutrition-and-hydration","tag-fraser-health-authority-british-columbia","tag-margot-bentley"],"yoast_head":"\r\n<title>Judge rules family cannot order caregivers to starve mother to death -
