{"id":4756,"date":"2013-12-20T05:17:12","date_gmt":"2013-12-20T13:17:12","guid":{"rendered":"https:\/\/news.consciencelaws.org\/?p=4756"},"modified":"2018-03-05T21:02:49","modified_gmt":"2018-03-06T05:02:49","slug":"supreme-court-of-canada-signals-change-in-jurisprudence","status":"publish","type":"post","link":"https:\/\/news.consciencelaws.org\/?p=4756","title":{"rendered":"Supreme Court of Canada signals change in jurisprudence"},"content":{"rendered":"<p>In a unanimous ruling, the Supreme Court of Canada has struck down\u00a0three laws restricting prostitution and suspended the effect of its ruling for one year to give the government an opportunity to draft replacement legislation.\u00a0 Some observers are of the view that the ruling increases the likelihood that assisted suicide or euthanasia will be legalized in Canada, either by judicial fiat or by legislation supporting such a change.\u00a0 In the prostitution judgement,\u00a0the court granted lower courts much greater latitude to set aside earlier Supreme Court precedents\u00a0if new legal issues are raised, or if there has been some other change that\u00a0&#8220;fundamentally shifts the parameters of the debate.\u201d<\/p>\n<p>The Supreme Court is set to hear an appeal from British Columbia in the case of <a href=\"https:\/\/www.consciencelaws.org\/law\/commentary\/legal073-001.aspx\" target=\"_blank\"><em>Carter v. Canada<\/em><\/a>, which turns on a precedent established by the Supreme Court in 1993 in the <em>Rodriguez<\/em> case.\u00a0 The circumstances are virtually identical (plaintiffs suffering from Lou Gehrig&#8217;s disease seeking a right to assisted suicide\/euthanasia).\u00a0 The Supreme Court judge in <em>Carter<\/em> distinguished the case from <em>Rodriguez <\/em>on some issues and ruled in favour of the plaintiff, but the British Columbia Court of Appeal overturned the ruling in a split decision, citing the <em>Rodriguez<\/em> precedent as binding.\u00a0 Since the Supreme Court accepted the trial judge&#8217;s finding in the prostitution case that new evidence required\u00a0a precedent to be set aside, counsel for the plaintiffs in the <em>Carter<\/em> case is optimistic that it will take the same approach when ruling on euthanasia.
