{"id":4709,"date":"2013-12-19T04:16:05","date_gmt":"2013-12-19T12:16:05","guid":{"rendered":"https:\/\/news.consciencelaws.org\/?p=4709"},"modified":"2018-03-06T13:22:36","modified_gmt":"2018-03-06T21:22:36","slug":"protection-of-conscience-provision-in-new-tasmanian-abortion-law","status":"publish","type":"post","link":"https:\/\/news.consciencelaws.org\/?p=4709","title":{"rendered":"Protection of conscience provision in new Tasmanian abortion law"},"content":{"rendered":"<p>The <em>Reproductive Health (Access to Terminations)\u00a0Bill 2013<\/em> passed the Tasmanian \u00a0Legislative Council 9-5 on 21 November [ <a href=\"http:\/\/www.examiner.com.au\/story\/1925158\/tasmania-leads-nation-as-abortion-bill-passed\/?cs=95\" target=\"_blank\"><em>The Examiner<\/em><\/a>] and received Royal Assent today.\u00a0 Abortions after 16 weeks will require the approval of two physicians.\u00a0 The new Act includes<a href=\"https:\/\/news.consciencelaws.orglaw\/laws\/australia003.aspx\" target=\"_blank\"> a protection of conscience provision <\/a>that exempts those who object to the procedure from participating in it, except when necessary to save the life of a woman or prevent serious physical injury.\u00a0 There is no requirement for referral, but an objecting physician must provide a woman &#8220;seeking a termination or advice regarding the full range of pregnancy options&#8221; a\u00a0&#8220;list of prescribed health services&#8221; from which she may seek advice.\u00a0 Since, subject to the content of the list, this does not seem to be the equivalent of referral for abortion, the requirement may not be problematic for those concerned about indirect moral complicity.<\/p>\n<p>What is not clear is whether or not the Act actually prohibits an objecting physician from providing information or advice about pregnancy options beyond the &#8220;prescribed&#8221; list.\u00a0 Section 7(4) states that an objecting physician may continue to &#8220;provide treatment, advice or counselling, in respect of matters <strong>other<\/strong> than a termination or advice regarding the full range of pregnancy options&#8221; (emphasis added) which could be taken to imply that an objecting physician is not permitted to offer a woman anything other than\u00a0the prescribed list.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Reproductive Health (Access to Terminations)\u00a0Bill 2013 passed the Tasmanian \u00a0Legislative Council 9-5 on 21 November [ The Examiner] and received Royal Assent today.\u00a0 Abortions after 16 weeks will require the approval of two physicians.\u00a0 The new Act includes a protection of conscience provision that exempts those who object to the procedure from participating in &hellip; <a href=\"https:\/\/news.consciencelaws.org\/?p=4709\" class=\"more-link\">Continue reading<span class=\"screen-reader-text\"> &#8220;Protection of conscience provision in new Tasmanian abortion law&#8221;<\/span><\/a><\/p>\n","protected":false},"author":5432,"featured_media":0,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[46,30,16,9],"tags":[3393],"post_folder":[],"class_list":["post-4709","post","type-post","status-publish","format-standard","hentry","category-abortion","category-australia","category-protection-of-conscience-laws","category-news","tag-tasmania-australia"],"yoast_head":"\r\n<title>Protection of conscience provision in new Tasmanian abortion law -
