{"id":3189,"date":"2013-07-01T03:48:04","date_gmt":"2013-07-01T10:48:04","guid":{"rendered":"https:\/\/news.consciencelaws.org\/?p=3189"},"modified":"2018-03-06T15:07:50","modified_gmt":"2018-03-06T23:07:50","slug":"protection-of-conscience-project-bimonthly-update","status":"publish","type":"post","link":"https:\/\/news.consciencelaws.org\/?p=3189","title":{"rendered":"Protection of Conscience Project Bimonthly Update"},"content":{"rendered":"<h2>By Region\/Country<\/h2>\n<h3>Australia<\/h3>\n<p>A physician in Melbourne, Australia, has openly defied the State of Victoria law that requires physicians who object to abortion to refer patients to colleagues who will provide the service.\u00a0 Dr. Mark Hobart\u00a0refused to refer a couple who wanted to abort a girl because they wanted a boy. [<a href=\"http:\/\/consciencelaws.org\/blog\/?p=2751\">Newstalk<\/a>]<\/p>\n<h3>Canada<\/h3>\n<p>The government of Quebec has introduced a bill to legalize euthanasia in the province, despite the continuing criminal prohibition of the procedure.\u00a0 <em>An Act respecting end-of-life care<\/em> (Bill 52) is intended to permit physicians, in defined circumstances, to kill their patients as part of the redefined practice of medicine (&#8220;medical aid in dying&#8221;; MAD). However, the procedure cannot become part of medical practice in Quebec unless the medical profession itself (broadly speaking) formally accepts it and delivers it through the structures and powers established for the delivery of health care. If Bill 52 passes, health care providers and others who want no part of euthanasia will find their working environments increasingly controlled by a MAD matrix functioning within this system.\u00a0 Moreover, having formally approved of euthanasia, the medical establishment will be at particular pains to defend and enforce the decision. In the end, freedom of conscience for Quebec health care workers who object to euthanasia may come to mean nothing more than the freedom to find another job, or the freedom to leave the province. [See <em> <a href=\"https:\/\/www.consciencelaws.org\/law\/commentary\/legal068.aspx\"> Redefining the practice of medicine: Winks and nods and euthanasia in Quebec<\/a><\/em>]<\/p>\n<h3>European Union<\/h3>\n<p>The Observatory on Intolerance and Discrimination against Christians released a <a href=\"http:\/\/consciencelaws.org\/blog\/?p=2811\">report<\/a> describing 41 examples of national laws with adverse effects on Christians in more than 15 European Countries. Additionally, 169 cases of intolerance against Christians in the EU \u2013 area in 2012 are portrayed.\u00a0 The Holy See has <a href=\"http:\/\/consciencelaws.org\/blog\/?p=2807\">denounced<\/a> European discrimination against and intolerance of Christians.<\/p>\n<h3>Ireland<\/h3>\n<p>The\u00a0<a href=\"http:\/\/s3.documentcloud.org\/documents\/713183\/protection-of-life-during-pregnancy-bill-2013.pdf\" target=\"_blank\"><em>Protection of Life During Pregnancy Act 2013 <\/em><\/a>will permit abortions when there is a &#8220;real and substantial risk&#8221; to the life of a woman by reason of physical illness or\u00a0suicidal ideation. The <em>Act\u00a0 <\/em>includes a <a href=\"https:\/\/www.consciencelaws.org\/archive\/pages\/2013-ireland-heads.aspx\" target=\"_blank\"> protection of conscience provision <\/a>that is limited to medical practitioners, midwives and nurses.\u00a0 A provision that denied freedom of conscience to institutions has been dropped.\u00a0 However, no conscientious objection will be allowed in emergencies when the mother&#8217;s life is in immediate danger.<\/p>\n<p>It is far from certain how\u00a0much difficulty the mandatory referral requirement\u00a0will cause, since the\u00a0<em>Act<\/em> envisions abortion only in circumstances involving a substantial risk to the mother&#8217;s life.\u00a0\u00a0This is very rare, and in such circumstances there is much less likelihood of conscientious objection, so the provision may not prove to be troublesome in practice.<\/p>\n<p>On the other hand, government comments accompanying the\u00a0earlier &#8220;heads of bill&#8221;\u00a0noted that medical practitioners do not need to be of the opinion that the risk to the woman&#8217;s life &#8220;is inevitable or immediate.&#8221; The more broadly this\u00a0interpretation is construed, the more likely it is that conflicts of conscience will occur, and the greater will be the surrounding controversy.\u00a0 Irish physicians speaking to an early draft of the legislation <a href=\"http:\/\/consciencelaws.org\/blog\/?p=2796\">expressed <\/a> differences of opinion about grounds for abortion.<\/p>\n<h3>Italy<\/h3>\n<p>Large numbers of Italian obstetricians are reported to be refusing to provide abortion for reasons of conscience &#8211; up to 80% of practitioners in some areas. Critics are demanding that steps be taken to ensure &#8220;access to abortion,&#8221; which may generate pressure to suppress freedom of conscience. [<a href=\"http:\/\/www.rte.ie\/blogs\/european\/2013\/06\/14\/conscientious-objection-a-controversial-issue-in-italys-abortion-regime\/\">RTE<\/a>; <a href=\"http:\/\/www.rte.ie\/news\/morningireland\/player.html?20130614,20212764,20212764,flash,232\"> Morning Ireland]<\/a><\/p>\n<h3>Netherlands<\/h3>\n<p>Only 400 of 20,000 Flemish physicians are trained to provide euthanasia.\u00a0 It appears that most physicians do not want to be directly involved with it.\u00a0 In consequence, the 400 are called upon frequently to provide the required second opinion and sometimes the lethal injection.\u00a0 Confirming the reluctance of physicians to participate in the procedure, Dr. Sarah Van Laer complains that &#8220;there are too few doctors ready to perform euthanasia&#8221; and that this is a&#8221;badly underestimated problem.&#8221; [<a href=\"http:\/\/www.bioedge.org\/index.php\/bioethics\/bioethics_article\/10577\" target=\"_blank\">Bioedge<\/a>]<\/p>\n<h3>Philippines<\/h3>\n<p>In order to simplify and expedite the\u00a0hearing scheduled for 9 July to review the <a href=\"http:\/\/consciencelaws.org\/law\/commentary\/legal055-001.aspx\" target=\"_blank\"> controversial Reproductive Health law<\/a>, the Supreme Court of the Philippines <a href=\"http:\/\/consciencelaws.org\/blog\/?p=3066\">has proposed<\/a> that the petitioners for and against the bill concentrate on three constitutional themes during their oral submissions:<\/p>\n<ul>\n<li>proscription of involuntary servitude<\/li>\n<li>equal protection clause (right to life, freedom of religion, natural law)<\/li>\n<li>freedom of speech (academic freedom)<\/li>\n<\/ul>\n<p>The suggestion by the court to include the proscription of involuntary servitude as one of the constitutional themes could be interpreted two ways and could include arguments of two kinds. The first is a claim that compelling someone to do something contrary to his conscientious convictions is a form of involuntary servitude. The second is a claim that a pregnancy that results from difficulty accessing contraception and\/or abortion is a form of involuntary servitude.\u00a0 In either case, the reference to the constitutional proscription of involuntary servitude is of particular interest because of a similar proscription in the 13th Amendment to the Constitution of the United States.<\/p>\n<h3>United Kingdom<\/h3>\n<p>The Family Planning Association has encouraged women to leave a medical practice in south London after anonymous complaints were reported in the media that some physicians in the clinic are unwilling to prescribe the morning-after pill for reasons of conscience. [<a href=\"http:\/\/www.independent.co.uk\/life-style\/health-and-families\/health-news\/christianrun-nhs-surgery-criticised-for-refusing-to-prescribe-morningafter-pill-8604481.html\" target=\"_blank\"><em>The Independent<\/em><\/a>]<\/p>\n<p>The National Health Service of\u00a0<strong>Greater Glasgow and Clyde<\/strong>, regional provider of state health care,\u00a0will attempt to overturn an <a title=\"Appeal succeeds in Scotland: freedom of conscience upheld for midwives\" href=\"http:\/\/consciencelaws.org\/blog\/?p=2549\" target=\"_blank\"> appeal\u00a0court ruling <\/a>favourable\u00a0to freedom of\u00a0conscience for health care workers by appealing to Britain&#8217;s Supreme Court.\u00a0 Two midwives who, for reasons of conscience,\u00a0refused to participate in the supervision and support of staff providing abortions successfully appealed a<a title=\"Scottish judge rules objecting midwives can be forced to facilitate abortions\" href=\"http:\/\/consciencelaws.org\/blog\/?p=1054\" target=\"_blank\"> lower court ruling <\/a>against them.\u00a0 The judgement of the appeal court was given in April.\u00a0 [<a href=\"http:\/\/www.irishpost.co.uk\/news\/catholic-midwives-abortion-objection-to-be-challenged-at-supreme-court\">Irish Post<\/a>]<\/p>\n<p>A bill introduced in the <strong>House of Lords<\/strong> by Lord Falconer\u00a0proposes to legalize assisted suicide.\u00a0 It includes a <a href=\"https:\/\/www.consciencelaws.org\/law\/proposed\/united-kingdom.aspx\"> protection of conscience provision <\/a>to protect those who do not wish to <em>participate <\/em>\u00a0in the procedure.\u00a0 <em>Participation<\/em> is the central issue in the midwives case noted above.<\/p>\n<h3>United States<\/h3>\n<p>The <strong>Department of Health and Human Services<\/strong> has confirmed a <a href=\"https:\/\/www.consciencelaws.org\/law\/commentary\/legal065-002.aspx\"> regulation<\/a> that will require businesses with over 50 employees to provide\u00a0health\u00a0insurance for\u00a0birth control and surgical sterilization, even if they object to doing so for reasons of conscience.\u00a0\u00a0The regulations includes\u00a0exemptions for objecting &#8220;religious employers&#8221; (largely limited to houses of worship) and objecting religious non-profit organizations.\u00a0 Nonetheless, the continued demand that\u00a0objecting business owners be forced to comply and the\u00a0nature of the exemptions remain\u00a0unacceptable to many religious organizations.\u00a0 Catholic and Baptist leaders have collaborated in writing a <a href=\"http:\/\/www.ncregister.com\/daily-news\/catholics-baptists-come-together-over-conscience-rights-bill\/\"> letter of protest<\/a> to Congress.\u00a0 American Catholic bishops have been adamant that the HHS regulation is unacceptable. There are now 61 civil suits filed against the regulation, with over 200 plaintiffs. [<a href=\"http:\/\/www.becketfund.org\/hhsinformationcentral\/\">Becket Fund, HHS\u00a0Information Central<\/a>].\u00a0The Archdiocese of New York is among the plaintiffs in the lawsuits.\u00a0 However, the Archdiocese\u00a0 has, for years,\u00a0been indirectly paying for health insurance for employees of the Catholic Health Care System that includes coverage for contraception and abortion. [<a href=\"http:\/\/www.nytimes.com\/2013\/05\/27\/nyregion\/new-york-archdiocese-reluctantly-paying-for-birth-control.html?pagewanted=1&amp;_r=0\"><em>New York Times<\/em><\/a>]<\/p>\n<p>A <strong>North Carolina<\/strong> bill that proposes to modify laws pertaining to abortion health insurance coverage includes a <a href=\"https:\/\/www.consciencelaws.org\/law\/proposed\/usa-north-carolina-006.aspx\"> protection of conscience provision<\/a> for health care workers and health care institutions.\u00a0 In <strong>Vermont<\/strong>, a new assisted suicide law allows for <a href=\"https:\/\/www.consciencelaws.org\/law\/laws\/usa-vermont.aspx\" target=\"_blank\"> protection of conscience<\/a> for health care workers and somewhat more limited protection for health care\u00a0 facilities.<\/p>\n<h2>\u00a0Recent\u00a0Postings<\/h2>\n<p><a href=\"https:\/\/www.consciencelaws.org\/ethics\/ethics079-010.aspx\"> Personal Opinions and Ideology, Not &#8220;Science&#8221;.<\/a>\u00a0 From <em>Conscience and its Enemies: Confronting the Dogmas of Liberal Secularism, <\/em>by Robert P.
