{"id":2549,"date":"2013-04-24T23:18:24","date_gmt":"2013-04-24T23:18:24","guid":{"rendered":"https:\/\/news.consciencelaws.org\/?p=2549"},"modified":"2013-06-07T01:06:18","modified_gmt":"2013-06-07T01:06:18","slug":"appeal-succeeds-in-scotland-freedom-of-conscience-upheld-for-midwives","status":"publish","type":"post","link":"https:\/\/news.consciencelaws.org\/?p=2549","title":{"rendered":"Appeal succeeds in Scotland: freedom of conscience upheld for midwives"},"content":{"rendered":"<p>A panel of judges of the Court of Session in Edinburgh, Scotland,\u00a0has ruled in favour of two midwives appealing a 2012 decision by a judge of the same court.\u00a0 Lady Dorrian,\u00a0 Lord Mackay of Drumadoon and Lord McEwan have ruled that the midwifery sisters, Mary Doogan, and Concepta Wood, cannot be compelled to supervise the provison of abortion by the National Health Services of Greater Glasgow and Clyde.<\/p>\n<p>The two women were\u00a0labour ward co-ordinators at the Southern General Hospital in Glasgow and had long identified themselves as\u00a0having conscientious objection to abortion.\u00a0 However, in 2007, when the labour ward was made responsible for abortions, they were ordered to supervise, support and delegate staff providing the procedure.\u00a0 They challenged the order as a breach of the European Convention on Human Rights on the grounds that it made them morally complicit in abortion by requiring their participation in the process of providing it.<\/p>\n<p>The appelate judges said, &#8220;In our view the right of conscientious objection extends not only to the actual medical or surgical termination but to the whole process of treatment given for that purpose.&#8221; [<a href=\"http:\/\/www.scotcourts.gov.uk\/opinions\/2013CSIH36.html\">Text of the ruling<\/a>]<\/p>\n<p>NHS Greater Glasgow and Clyde is considering an appeal of the decision.
